Question by stuartmitchell1987: Bad Practices and Offences?
Strangely this is a question i have as part of an ICT module in my university degree however when i read it, there appears to be hints of law about it, so from a law point of view (which im not studying) what bad practices/offences have been commited in this scenario? apart from the obvious being Copyright infringement.

"John and Jill start their new job as application developers at NewTech Solutions. They are assigned to a project designing and building Web applications for social networking. Both John and Jill were working on a similar project at a rival company, OldSoft Systems, before they were head-hunted by NewTech.
Four months into their new job, they realise that there are sections of code that they wrote whilst working for OldSoft that they could use in the system now being developed for NewTech. Jill had made a copy of some of that code before leaving OldSoft, and so uses it in the new application. John tries to retrieve the rest of the code by trying to remotely log in to the OldSoft intranet; and to his surprise he finds that his old username and password are still active. He therefore logs into OldSoft’s intranet and retrieves the code, which he then uses in the NewTech system."

Without knowing the jurisdiction, this question is impossible to answer. Also, I have no idea what you mean by "bad practices." That has nothing to do with the law.

What do you think? Answer below!
